We are delighted at the prospect of helping you create a beautiful and memorable event. These Terms and Conditions ("Terms") govern the services provided by Celebration Kit ("we," "us," "our") to you, the client ("you," "your"). By booking our services, you agree to be bound by these Terms. Please read them carefully.

Definitions

“Services” refers to all picnic packages, event styling services, DIY hire, catering, add-ons, and any other offerings provided by Celebration Kit.

“Booking” refers to a confirmed reservation for our Services, secured by a Deposit.

“Event Date” means the date on which the Services are to be provided.

“Deposit” means the non-refundable 50% payment required to secure a Booking.

“Fees” means the total cost payable by you for the Services, as outlined in your quote or invoice.

Bookings & Confirmation

2.1. Enquiries: All enquiries can be made via our website, email (events@celebrationkit.com.au), or phone (1300 290 183).
2.2. Availability: All Bookings are subject to availability. We recommend booking well in advance, especially for peak season dates and weekends.
2.3. Securing Your Booking: To secure your Booking for our Services, a 50% non-refundable Deposit of the total quoted Fee is required. Your Booking is not confirmed, and your Event Date is not held, until this Deposit has been received and acknowledged by us in writing (e.g., via email confirmation).
2.4. Minimum Spend: For DIY Hire services, a minimum spend of $150 per booking applies.

Payments

3.1. Deposit: The 50% non-refundable Deposit is due upon making a reservation to secure your Event Date and Services.
3.2. Final Payment: The remaining balance of the Fee is due and must be cleared no later than seven (7) days prior to your Event Date. We reserve the right to cancel your Booking if final payment is not received by this deadline, and the Deposit will be forfeited.
3.3. Payment Methods: We accept payment via Direct Bank Transfer, Credit Card via Stripe. Details will be provided on your invoice.
3.4. No Cash on Day: We do not accept cash payments on the Event Date. All Fees must be paid in full and cleared prior to the event as per clause 3.2.
3.5. Pricing: All prices are quoted in Australian Dollars (AUD) and are inclusive of GST, unless otherwise stated. We reserve the right to amend our prices at any time, however, prices for confirmed Bookings will be honoured.

Cancellations & Rescheduling

4.1. Cancellation by You:
a. The 50% Deposit is non-refundable under any circumstances, as this secures your Event Date and Services, preventing us from accepting other bookings for that time.
b. If you cancel your Booking more than seven (7) days prior to the Event Date, you will forfeit the Deposit, but no further charges will apply (unless specific non-refundable costs for custom items or third-party services have already been incurred on your behalf, which will be communicated).
c. If you cancel your Booking seven (7) days or less prior to the Event Date, you will forfeit all monies paid, and the full Fee for the Services will remain due and payable. No refund will be given.
4.2. Rescheduling by You (General):
a. Excluding Wet Weather (see Clause 5), requests to reschedule your Event Date are subject to our availability and at our sole discretion.
b. If we can accommodate a reschedule request made more than 72 hours prior to the original Event Date, one (1) reschedule may be permitted without an administration fee, subject to availability. Any subsequent reschedule requests will be treated as a new booking, and full booking charges will apply.
c. Reschedule requests made 72 hours or less prior to the original Event Date (excluding Wet Weather as per Clause 5) will incur a reschedule fee of $150.00 plus any non-refundable catering or third-party costs already incurred by us.
4.3. Cancellation by Us: a. We reserve the right to cancel your Booking in the unlikely event of unforeseen circumstances (e.g., staff illness, equipment failure, extreme safety concerns beyond weather). Should this occur, we will notify you as soon as possible and offer you the choice of:
i. A full refund of all monies paid, including the Deposit; or
ii. Rescheduling your event to a mutually agreeable future date at no additional charge. b. We will not be liable for any further compensation or for any other losses or expenses you may incur as a result of such cancellation.

Wet Weather Policy

5.1. Celebration Kit will not set up an event in an unprotected outdoor location if significant wet weather (e.g., rain, storms) or high winds are forecast that would compromise the safety of our staff and equipment, or the enjoyment of your event.
5.2. We will monitor the weather forecast closely in the days leading up to your event. If adverse weather is likely, we will contact you at least 24-48 hours prior (or sooner if the forecast is clear) to discuss the following options:
a. Option 1: Marquee Hire: If permitted at your chosen outdoor location and feasible, we can arrange for a marquee to be set up. This will incur an additional cost, which will be quoted to you.
b. Option 2: Postponement: You may postpone your event to another available date, free of charge on one (1) occasion, provided you give us more than 72 hours’ notice prior to the original Event Date. The rescheduled date is subject to our availability.
i. Reschedule Fee for 72 Hours or Less Notice (Wet Weather): If you choose to postpone due to wet weather with 72 hours or less notice prior to the original Event Date, a reschedule fee of $150.00 will apply, plus the full cost of any catering that has already been prepared or ordered and cannot be cancelled.
c. Option 3: Relocation: You may relocate your event to a suitable indoor venue. The proposed indoor venue must be pre-approved by us to ensure suitability regarding accessibility, space, and our scheduling feasibility. If the new location is outside our standard Sydney service areas, further delivery charges may apply.
d. Option 4: Gift Voucher: You may receive a gift voucher for the full amount paid (including the Deposit). This credit can be used for a future Booking with Celebration Kit and will be valid for twelve (12) months from the date of issue.
5.3. No Refunds for Wet Weather: Refunds will not be issued on the grounds of wet weather if you choose not to proceed with any of the above options, as your Event Date has been held, thus denying other bookings.

Client Responsibilities

6.1. Venue & Permits: You are responsible for selecting and securing a suitable location for your event. If your chosen location (e.g., public park, beach) requires any permits, licenses, or access fees, you are solely responsible for obtaining and paying for these in advance. Celebration Kit is not responsible for any fines or penalties incurred due to lack of appropriate permits.
6.2. Access & Site Conditions: You must ensure that the event location is accessible and suitable for our setup (e.g., flat ground, clear of obstructions). Please advise us of any potential access issues (e.g., stairs, long distances from parking) at the time of booking. Additional fees may apply if access is difficult.
6.3. Supervision & Safety: You are responsible for the supervision and safety of your guests and any children present during the hire period.
6.4. Damages & Loss:
a. You are responsible for all hired equipment during your hire period (from the completion of setup by us until we commence pack-down, or for DIY Hire, from pick-up until return).
b. Any loss, theft, or damage to Celebration Kit equipment (including, but not limited to, tables, rugs, cushions, decor, tableware) caused by you or your guests (excluding fair wear and tear) will be charged to you at the full replacement cost.
c. A refundable security bond may be required for certain Bookings, particularly for DIY Hire or larger events. This will be advised at the time of quoting and will be refunded within seven (7) days after your event, provided all equipment is returned undamaged. 6.5. Cleaning: For full-service packages, we handle the cleaning of our equipment. For DIY Hire, items should be returned reasonably clean (e.g., food scraps removed from plates). Excessive soiling may incur a cleaning fee.
6.6. Late Arrivals by Client: If you or your guests are late to your scheduled event start time, please notify us as soon as possible. We can wait up to 15 minutes without charge. Delays beyond this may incur fees as follows:
* 20-40 minutes late: $50 fee
* 40-60 minutes late: $80 fee
These fees compensate for impacts on our subsequent scheduling and staff time. The hire period will commence from the original booked start time.
6.7. Dietary Requirements & Allergies: You must inform us of any dietary requirements or allergies for your group at the time of booking or no later than seven (7) days prior to the Event Date. While we take utmost care, our food is prepared in a kitchen where allergens may be present. We cannot guarantee a completely allergen-free environment.

DIY Hire Specifics

7.1. Pick-up & Return: All DIY Hire equipment is to be picked up from and returned to our Miranda warehouse (14 Batchelor Close, Menai NSW 2234, or other specified Miranda location) by appointment only, within the agreed 24-hour hire period. Late returns will incur additional daily hire fees.
7.2. Setup & Pack-down: You are responsible for the correct and safe setup, styling, and pack-down of all DIY hired equipment.
7.3. Disclaimer: While we strive to provide all requested DIY items, specific items are subject to availability. Any necessary substitutions will be of equal or greater value and style.

Limitation of Liability

8.1. To the maximum extent permitted by law, Celebration Kit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) any conduct or content of any third party on the Services; or (c) unauthorized access, use, or alteration of your transmissions or content.
8.2. Our total liability to you for any claim arising out of or relating to these Terms or the Services, whether in contract, tort, or otherwise, will not exceed the total Fees paid by you to us for the specific Services giving rise to the claim.
8.3. Nothing in these Terms is intended to exclude, restrict or modify any rights that you have under the Australian Consumer Law (ACL) that cannot be lawfully excluded, restricted or modified.

Photography & Social Media

9.1. We love to capture the beauty of our setups! We may take photographs or videos of our styling at your event for our promotional purposes (e.g., website, social media). We will always aim to do so discreetly and respectfully.
9.2. If you do not wish for photographs/videos of your event to be used, please notify us in writing prior to your Event Date. We will always respect your privacy if requested.

General Provisions

10.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales.
10.2. Entire Agreement: These Terms, along with your confirmed Booking details and invoice, constitute the entire agreement between you and Celebration Kit regarding our Services and supersede all prior agreements and understandings, whether oral or written.
10.3. Amendments: We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website or otherwise notifying you. Your continued use of our Services after such changes will constitute your acceptance of the new Terms. For existing Bookings, the Terms in place at the time of your Deposit payment will generally apply, unless changes are required by law. 10.4. Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
10.5. Force Majeure: We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, pandemics, government restrictions, or extreme weather events not covered by our standard Wet Weather Policy.
